5 Things to Know Before Working with a Patent Attorney and Bringing Your Product to Life
1. Avoid Public Disclosure and Sale Traps
If you tell someone how to make and use your invention or sell it or even offer it for sale, then you will lose most of your patent rights in the US and around the world. Before you tell it and before you sell it, you better call Childs Patent Law.
2. Will you win the race to the Patent Office?
There are NO second chances in Patent Law. Just ask Elisha Gray. Who? Exactly. Elisha Gray filed his patent application for the telephone just 2 hours after Alexander Graham Bell. Alexander Graham Bell went on to become one of the richest and most famous inventors in history. He co-founded AT&T. Elisha Gray -- did not. Bottom line: if someone else files a patent application on your invention before you, then you lose the race to the patent office.
3. Provisional Applications Must Be Detailed
Many inventors underestimate provisional applications, but inadequate descriptions can lead to loss of priority rights. If your claims are not adequately supported (nearly word for word) by your provisional application, then you will not be entitled to the filing date as your invention date. In other words, it will be as if you didn’t file a provisional application at all.
4. Understand the 18 to 24 Month Timeline
Expect your first patent office response 18 to 24 months after filing a regular US non-provisional application. Rejections are normal: over 90% of applications receive initial rejections. Plan for multiple rounds of responses and amendments during prosecution.
