Right off the bat, I was impressed with Attorney Iwashko’s professionalism and competence. Without the help of Attorney Iwashko, I would not have had such a successful outcome regarding my particular situation. Mr. Iwashko took on my difficult case without hesitation. He worked tirelessly to make sure that the truth was told and presented it perfectly. He has stood by every one of my requests and guided me through the entire lengthy legal process. Though we faced challenges, Mr. Iwashko did not falter. His thorough research and negotiation skills provided me with the pathway that I needed to rise to victory. I will only recommend Iwashko Law as I was treated with the utmost respect and Mr. Iwashko is an extremely skilled and knowledgeable attorney. I am proud to be an Iwashko Law client and will continue to retain this firm for all legal matters, including my upcoming Trademark and Patent registrations, as I know I am in the most capable hands.

Paul

I provide the highest possible recommendation for The Iwashko Law Firm. I have worked with Mr. Iwashko on a variety of trademark and patent cases ranging from registering multiple new trademarks, litigating existing trademarks, and filing and registering patents. What sets apart Mr. Iwashko's work? (1) He cares about his clients and sets your interests as his. He works for your best result and does not "nickel and dime" you for every little thing. He treats large and small clients with the same care and respect. (2) Mr. Iwashko knows patent and trademark law. Period. Inside and Out. He has spent countless time explaining the law to me to make sure that we make informed decisions in some challenging situations. (3) Mr. Iwashko's communications skills (writing/speaking/presenting) are the best I have seen in the legal profession. (4) Creativity - every time we submit a new invention, Mr. Iwashko adds to the value of the intellectual property by viewing the invention from multiple angles and actually increases the value of the invention through making the patent stronger. Finally, in my first small business venture, we were concerned when our business name was challenged by another company. Mr. Iwashko guided us through a 2 year process where we ultimately achieved the most desired outcome.

Make your Patent Work for You

Securing intellectual property is a key step for innovation - but what happens next? 52 Launch offers a path beyond the patent to bring the product to real users: product development, branding, prototyping, and go-to-market strategy.

5 Things to Know Before Working with a Patent Attorney and Bringing Your Product to Life

1. File Early - The First-to-File System is Critical

The US operates on a first-to-file system, meaning whoever files first gets priority rights. In competitive fields where multiple innovators might be solving the same problem, filing as early as possible becomes crucial for securing your invention rights.

2. Avoid Public Disclosure Traps

You have only 1 year from any public disclosure to file your patent application, or you lose your rights forever. Be extremely careful about presentations, publications, or detailed discussions without NDAs - even university presentations can invalidate your patent rights.

3. Provisional Applications Must Be Detailed

Many inventors underestimate provisional applications, but inadequate descriptions can lead to loss of priority rights. Be as detailed as possible - if you don't adequately describe your invention, you're not entitled to the filing date as your invention date.

4. Understand the 18 to 24 Month Timeline

Expect your first patent office response 18 to 24 months after filing. Rejections are normal: over 90% of applications receive initial rejections. Plan for multiple rounds of responses and amendments during prosecution.

5. Align Patent Strategy with Business Strategy

File patents on innovations that create competitive moats, not just any invention. Focus on high-leverage opportunities that add real value to your company: each patent should be a strategic asset that supports your core value proposition and fundraising goals.
